 Waititu graft case proceeds for defence hearing

Today marks a crucial day in the courtroom as high-profile corruption cases involving several prominent figures proceed. Among the key cases is the Sh588 million graft scandal involving former Kiambu County Governor Ferdinand Waititu and several others.

The case returns to court for a defense hearing, with the focus on allegations of procurement irregularities related to a major roads tender. During the last court session, Lucas Wahinya, a former roads official at Kiambu County, testified about contentious changes in the tender evaluation process. Wahinya disclosed that the new criterion of serialization—added during the evaluation stage—was not part of the original bid documents. This adjustment, he stated, unfairly disadvantaged several bidding companies.

Wahinya defended his actions, asserting that he adhered to due process despite objections from Justus Bundi, the Director of Supply Chain Management. Bundi had previously testified that the introduction of serialization altered the tender’s outcome, calling for a re-evaluation or the formation of an ad hoc committee to reassess the bids. His recommendations, however, were reportedly ignored.

The tender in question involved upgrading various gravel roads across Thika, Limuru, Gatundu North, Juja, and Ruiru subcounties during the 2017-2018 financial year.
