High court orders hospital to pay Ksh 157 Million for medical negligence

The High Court has ruled that Aga Khan Hospital must compensate Ms. Naila Qureshi with Ksh 157,207,524 for medical negligence that caused her permanent injuries. Justice Alexander Muteti delivered the verdict, concluding an 18-year legal battle that began in 2007.

Ms. Qureshi underwent surgery at Aga Khan Hospital between 2005 and 2006. However, medical staff failed to provide adequate care, leading to severe complications that permanently affected her health. Consequently, she filed a lawsuit, demanding justice for the harm she suffered. After years of litigation, the court finally ruled in her favor.

Justice Muteti determined that the hospital and the attending doctor had violated their duty of care, causing irreversible damage. Furthermore, the court recognized that Ms. Qureshi’s injuries had cost her employment and significantly diminished her quality of life. As a result, the court awarded her Ksh 157 million to cover medical expenses, lost income, and damages for pain and suffering.

This ruling reinforces the importance of patient rights and medical accountability. Additionally, it serves as a warning to healthcare providers about the severe consequences of negligence. Legal experts believe this decision will encourage more victims of malpractice to seek justice.
