Senate opens public hearings uproar over constitution amendment bill, 2025

The Senate has invited Kenyans to give their views on the Constitution of Kenya (Amendment) Bill, 2025, following heated reactions online and in Parliament over fears it could alter presidential term limits.

In a notice issued by Clerk of the Senate Jeremiah Nyegenye, the House confirmed the Bill, tabled for First Reading on August 7, had been referred to the Standing Committee on Justice, Legal Affairs and Human Rights. The Committee is mandated to conduct public participation before presenting its report.

Kenyans have been urged to submit written memoranda to the Office of the Clerk at Parliament Buildings in Nairobi or via email by September 26, 2025, at 5 pm. The Senate also announced that public hearings will be conducted across all 47 counties, with dates and venues to be released later.

The Bill, along with an official digest, has been uploaded to the Parliament website for public access.

“The Committee is required to take into account the views and recommendations of the public when making its report to the Senate,” Nyegenye stated.

According to the Senate, the Bill aims to address challenges of constitutional design and governance, strengthen devolution, and refine the roles of the National Assembly and Senate. Among its key proposals are clarifying legislative mandates, securing Senate participation in the budget-making process, and eliminating overlaps between the two Houses.

If enacted, the Bill would give both Houses full legislative authority, introduce a joint procedure on national revenue and expenditure, repeal the definition of “money Bill,” and require Bills to be jointly submitted for presidential assent. It also proposes the establishment of a County Assembly Fund to safeguard financial independence of county assemblies, and a shared role in approving or removing state officers and commissioners.

Reactions on social media remained divided, with some Kenyans accusing Parliament of pushing reforms through opaque processes, while others called for calm and wider public participation.
