Tobacco producers and retailers are bracing for tougher regulations after the Senate Health Committee endorsed the Tobacco Control (Amendment) Bill, 2024, which seeks to tighten control over tobacco and emerging nicotine products.
The Bill, sponsored by nominated Senator Catherine Mumma, aims to expand oversight beyond traditional cigarettes to include modern nicotine alternatives such as vapes and pouches. The committee, chaired by Uasin Gishu Senator Jackson Mandago, recommended the Bill proceed to the next stage with only minor adjustments.
“This is necessitated by the current situation where products have been introduced into the market and distributed without authorization or understanding of their public health impact,” Senator Mumma said.
The legislation maintains the current ban on tobacco advertising, online sales, and promotions a move strongly opposed by major companies, including British American Tobacco, which argued the restrictions were overly punitive.
Under the proposed law, anyone involved in the manufacture, distribution, or sale of tobacco and nicotine products must obtain mandatory licences. County governments will also be empowered to impose additional taxes, and sales will be limited to authorized outlets effectively ending street vending of cigarettes.
The Bill also seeks to ban the use of additives and flavorings such as menthol, fruits, alcohol, and herbs, citing their appeal to young users.
“Allowing such additives would make tobacco products more attractive to youth and children,” the committee noted, adding that the restrictions are essential to protect public health.
With the committee’s approval, the Bill now moves closer to becoming law a significant win for health campaigners and a major blow to tobacco industry players lobbying for softer controls.
