Kenyans facing land disputes may soon get faster resolutions if the Environment and Land Court (Amendment) Bill, 2025, becomes law. The Bill, introduced by Nominated Senator Tabitha Mutinda, sets a two-year deadline for all land court cases from the date they are filed.
Delays in the Environment and Land Court (ELC) have long frustrated litigants, with some cases dragging for years. By December 2024, 13,971 disputes were pending, including 9,335 older than a year. Milimani, Thika, and Eldoret recorded the highest backlogs.
Senator Mutinda says the amendment will ensure timely justice and reduce case congestion. The Senate’s Justice, Legal Affairs, and Human Rights Committee has approved the Bill for publication and first reading.
Technology upgrades, mediation, and efficiency measures have already helped the court clear more cases than it receives, but the new law aims to guarantee that no dispute lingers unnecessarily, providing Kenyans a quicker path to justice in a sensitive sector.
