Lawyers under the Law Society of Kenya (LSK) Busia branch have issued Chief Justice Martha Koome a 21-day ultimatum to transfer Chief Magistrate Edna Nyaloti over alleged threats to her life.
The standoff has already paralysed operations at the Busia Law Courts for three days after lawyers boycotted proceedings, insisting that the magistrate’s security remains at risk.
“All advocates within the jurisdiction of Busia Law Courts shall withdraw legal services and shall not attend court sessions before Busia Law Courts number 1 presided over by Chief Magistrate Edna Nyaloti until she is transferred to another station,’’ said Nabulindo Dolan, President of the Busia LSK branch.
The crisis follows Nyaloti’s warning that brokers have infiltrated the courts, turning legal processes such as surety and case withdrawals into a business. In a statement dated Tuesday, August 19, the magistrate accused certain individuals of commercialising bonds and issuing threats to judicial staff.
In response, Busia lawyers abandoned proceedings and are demanding the CJ relocate her immediately, warning that services in all courts within the county will remain paralysed until action is taken.
“If Hon. Edna Nyaloti is not transferred within the next 21 days, advocates shall withdraw their services in all courts within Busia County, including the newly established Malaba Law Courts and Port Victoria Law Courts,” they warned.
The lawyers maintain their demand is about safeguarding the magistrate’s life and ensuring justice is administered without fear or intimidation.
Concerns over the safety of judicial officers are not new. In June 2024, a Chief Magistrate at Makadara Law Courts was shot and killed by a police officer unhappy with a ruling, an incident that renewed debate on security for magistrates nationwide.
