Court denies bail to former Nairobi OCS Talaam and five others in Albert Ojwang murder case

The High Court has denied bail to former Nairobi Central Police Station OCS Samson Talaam and five other suspects charged with the brutal murder of teacher and blogger Albert Ojwang while in police custody.

Delivering the ruling on Tuesday, Lady Justice Diana Kavedza directed that Talaam, Police Constables James Mukhwana and Peter Kimani, together with three others, remain in custody as the case proceeds.

The prosecution had argued that releasing the six could interfere with witnesses and ongoing investigations by the Independent Policing Oversight Authority (IPOA). While Justice Kavedza dismissed the lack of evidence on interference claims, she underscored the risk to public safety, citing widespread protests, destruction of property, and the torching of a police station following Ojwang’s death.

“The right to bail is not absolute and may be limited where its exercise undermines public confidence in justice or jeopardizes public interest,” Justice Kavedza ruled.

The judge added that releasing the accused at this stage could trigger unrest and threaten national security. However, she left the door open for a fresh bail application once key civilian and police witnesses testify.

The suspects are accused of orchestrating an assault on Ojwang while in custody at Central Police Station, leading to his death on June 8.
