The Milimani High Court Anti-Corruption and Economic Crimes Division has reduced the bond terms for former Kiambu Governor Ferdinand Waititu, paving the way for his release from custody.
In a ruling delivered on Wednesday, Lady Justice Wilfrida Okwany allowed Waititu to post Ksh20 million cash bail in place of the earlier Ksh53.5 million bank guarantee.
The court also provided an alternative option requiring two sureties backed by property worth not less than Ksh30 million each, subject to strict verification by the deputy registrar.
Waititu had moved to court through his lawyer Christopher Ndolo Mutuku, arguing that it had become impossible to secure the bank guarantee issued six months ago. In his application filed under a certificate of urgency, the former governor cited financial and practical challenges in complying with the earlier court order.
However, the Directorate of Public Prosecutions opposed the application. State Counsel Mwamburi argued that the applicant had not met the legal threshold required for review of bond terms, insisting there were no sufficient grounds to justify the variation.
Despite the objection, the court found merit in the application and granted the revised bail conditions.
As part of the new terms, Waititu has been ordered to deposit his passport in court. Should he need to travel, he must formally apply for permission before the same court.
The ruling now clears the way for the former county boss to secure his freedom pending the determination of his case.
