CS William Kabogo defends Cybercrime Law, says critics misled by misinformation as online uproar grows

Information, Communications and Digital Economy Cabinet Secretary William Kabogo has defended the newly enacted Cyber and Computer Crimes Act, saying criticism against the law is based on misinformation and misinterpretation.

Speaking during an interview on Tuesday, Kabogo said the law, which was signed by President William Ruto on October 15, 2025, is designed to bring order to Kenya’s digital space and protect citizens from cyberbullying, scams, and other online crimes.

“We’ve seen people take their own lives because of cyberbullying, and others whose reputations have been destroyed online. If we don’t act, this could become the next big pandemic,” Kabogo said.

He dismissed claims that the law seeks to restrict freedom of speech or online expression, stressing that its focus is on protection, not suppression.

“Governments come and go, but laws remain. There is no intention to create laws that work against Kenyans,” he stated.

Kabogo pointed out that while digital platforms have created new economic opportunities, they have also become breeding grounds for criminal activity, including child pornography, identity theft, and revenge pornography.

“This law protects Kenyans, not the government. Why would the government be interested in pornography? It’s about protecting people from exploitation,” he said.

The CS said the Act gives law enforcement agencies a clearer framework for prosecuting cybercrimes that were previously hard to handle due to legal loopholes. He revealed that Kenya experiences an average of two million cyberattacks every day, underscoring the urgent need for tighter digital security laws.

“There are syndicates involved in child trafficking and other crimes that operate online. Kenyans are among the most active internet users in Africa that’s why regulation is necessary,” he added.

Kabogo maintained that the law is not oppressive but is intended to deter criminal behavior online.

“The law is only harsh to those on the wrong side of it. Without regulation, online spaces would descend into anarchy,” he noted.

The Computer Misuse and Cybercrimes (Amendment) Bill, 2024, sponsored by Wajir East MP Aden Mohamed, strengthens penalties for online crimes such as phishing, SIM-swap fraud, cyber harassment, and identity theft.

Under the amendments, offenders found guilty of cyber harassment could face a fine of up to Ksh 20 million or a 10-year jail term, while those involved in phishing schemes risk a fine of up to Ksh 300,000 or three years in prison.

The law also introduces a new offence of unauthorized SIM-swap, punishable by up to two years in jail or a fine of Ksh 200,000.

Kabogo urged Kenyans to read and understand the law rather than rely on misinformation circulating online, insisting it is a necessary safeguard for a country rapidly moving into the digital age.
