Government tables landmark bill to ensure fair representation and equal opportunities for Kenya’s marginalized communities

The government has introduced the Ethnic Minorities and Marginalized Communities Bill, 2025, in Parliament a landmark move aimed at promoting fairness, equality, and inclusion for historically disadvantaged groups across Kenya.

The Bill, which is now open for public input, seeks to guarantee that all recognized ethnic and minority communities are adequately represented in employment, decision-making, and public service appointments.

At the heart of the proposed law is the requirement that every public body ensures equality of opportunity and non-discrimination in all its functions. It further compels both public and private institutions to create opportunities through targeted recruitment, training, and apprenticeship programs.

“The national and county governments shall ensure equitable representation of recognized communities in public service appointments, boards, commissions and decision-making bodies,” the Bill states.

To ensure compliance, public institutions will be required to publish annual reports showing representation data within their establishments, enhancing transparency and accountability.

The legislation also proposes the establishment of a Unit for the Promotion of Minorities and Marginalized Communities under the Office of the President. This unit will coordinate identification, data collection, and implementation of inclusion policies nationwide.

President William Ruto has consistently underscored the importance of unity and equitable development, calling on all political parties including ODM and Kanu to support the broader inclusion agenda.

If enacted, the Bill will operationalize key constitutional principles of equality and inclusivity, ensuring that every Kenyan community, regardless of size or status, has a fair stake in the country’s development.
