High Court blocks State House church construction pending full constitutional review

The High Court has temporarily barred the government from building a church at State House, Nairobi, or on any other state-owned property, ruling that the matter raises critical constitutional questions on the separation of religion and State.

The decision follows a petition filed by several civil society groups against the Sh1.2 billion church project.

Justice Chacha Mwita, in a ruling on Thursday, issued a conservatory order restraining the government, its officers, and agents “from constructing a permanent church or building associated with any religious faith within the Grounds of State House, Nairobi or any other State House or State Lodges until 18th November 2025.”

The petitioners, Transparency International Kenya, the Kenya Human Rights Commission, Inuka Kenya ni Sisi, the Institute of Social Accountability, Katiba Institute, and the State Law Office, argue that the project violates Article 8 of the Constitution, which upholds Kenya’s secular character and the separation of religion from State affairs.

Justice Mwita emphasized that the case presents issues of “significant constitutional importance” requiring urgent judicial review.

“I am satisfied that the application and petition raise fundamental constitutional and legal questions touching on State and religion which require urgent investigation and further consideration by the court,” Justice Mwita ruled.

The court ordered all parties to serve and file pleadings within seven days, with petitioners and respondents given equal timelines for supplementary affidavits and submissions. The case will be heard on November 18, 2025.

The ruling also carried a penal notice, warning that defying the court order would result in legal consequences.

Civil society groups, represented by lawyer Lempaa Suiyanka, accused President William Ruto of direct involvement in the project, arguing that it undermines constitutional principles.

“The President of the Republic of Kenya has, through public statements and government action, confirmed his direct involvement in the construction of a church within State House Nairobi, a public institution and symbol of the Kenyan State,” the petition reads.

They further claimed that despite assertions of private funding, public resources, including land, facilities, and personnelare already in use without parliamentary approval or citizen participation.

The petitioners accuse the President of abuse of office, misuse of public resources, and violating Article 10(2) of the Constitution, which enshrines values of transparency, accountability, and public participation.

“The reported construction of a religious facility within State House, a public property held in trust by the President, was carried out without any form of consultation. This omission violates the constitutional principle of participatory governance,” Lempaa argued.

The matter is expected to set a key precedent on the balance between religion and governance in Kenya.
