High Court Extends Order Halting JSC Petitions Against Chief Justice Martha Koome

The High Court extended interim orders stopping the Judicial Service Commission (JSC) from hearing petitions against Chief Justice Martha Koome and six Supreme Court judges. Justices Charles Kariuki, Lawrence Mugambi, and Bahati Mwamuye ruled that the conservatory orders will remain until July 4, 2025.

Former Law Society of Kenya (LSK) President Nelson Havi and 15 others filed petitions challenging Koome’s tenure. They claim multiple grievances justify her removal. However, the court’s ruling prevents JSC from taking action until the case is fully heard.

The court also gave Koome and four Supreme Court judges until May 21, 2025, to amend their petitions. Their lawyer, Julius Kemboi, requested more time to include new details before hearings begin.

To streamline proceedings, the judges combined all seven petitions, citing their similar constitutional concerns. Havi asked whether the petitions should be heard separately or together. The court decided that consolidation would ensure efficiency.

Following this, judges set clear timelines. The Deputy Registrar must finalize the list of parties by May 19, 2025. All parties, including the Supreme Court judges, JSC, and the Attorney General, must submit hard copies of their pleadings by May 21, 2025. JSC and the Attorney General have until May 25, 2025, to respond.

Petitioners and supporting parties must file arguments by June 10, 2025. Opposing parties, including JSC, AG, Havi, and 14 others, must submit responses by June 17, 2025.

Justice Mugambi confirmed that conservatory orders will remain until the petition is resolved. This prevents JSC from proceeding with any removal processes. The case will be mentioned on July 4, 2025, when the court will set dates for submission hearings.
