In a significant development at the Milimani law courts, Kamenu Ward MCA Peter Mburu Mungai and Patrick Ng’anga Mungai faced serious allegations as they were arraigned to answer to charges of conspiracy and publication of false information.
These charges, stemming from events allegedly occurring between the 10th and 17th of May, 2024, have brought attention to critical issues surrounding land ownership and the spread of misinformation.
The primary charge against the two individuals revolves around Section 293 of the Penal Code, which pertains to conspiracy to commit a felony.
According to the allegations, MCA Peter Mburu Mungai and Patrick Ng’anga Mungai, along with others not yet brought before the court, purportedly conspired to falsely claim that land parcel no. Thika Municipality Block 30/1825 in Kiganjo within Kamenu Ward was County Government land.
The prosecution contends that they knowingly or should have known that the land in question belonged to Kiganjo Location Ranching CO. LTD and had been transferred to the National Government for the development of the Kiganjo Kimuchu Modern Market.
Additionally, Patrick Ng’anga Mungai is charged with the publication of false information contrary to Section 22(2)(1) of the Computer Misuse and Cybercrime Act No. 5 of 2018.
It is alleged that he utilized his mobile number to disseminate false information via a WhatsApp group named NGOLIBA WARD LATEST.
The prosecution asserts that he was aware or should have been aware of the falsity of the information, and that it had the potential to incite violence.
During the court proceedings, both individuals denied all four charges brought against them. They were subsequently released on bail, with the option of a Ksh.600,000 bond and surety of the same amount, or an alternative cash bail of Ksh.200,000, each requiring two contact persons
