KRA, Transport and Cooperatives Ministries push for key changes in Khalwale’s motorcycle regulations bill

The Kenya Revenue Authority (KRA) and the Ministries of Transport and Cooperatives have proposed amendments to the controversial Motorcycle Regulations Bill, sponsored by Kakamega Senator Boni Khalwale.

The proposals were presented before the National Assembly’s Transport Committee, which is reviewing submissions from stakeholders.

The Transport Ministry said it supports most provisions of the Bill but raised concern over the scrapping of Sections 21 and 22 of the NTSA Act, which anchor County Transport and Safety Committees (CTSCs). The Ministry warned that replacing them with new County Transport Boards would duplicate roles and lead to wastage of public funds.

KRA, on its part, called for boda boda riders to provide proof of tax compliance before registering motorcycles for commercial use. The Authority also asked for clarity on the role of County Executive Members in charge of transport. Additionally, KRA recommended that both riders and passengers be required to sit astride motorcycles, with exemptions for persons with disabilities.

The Ministry of Cooperatives proposed that boda boda saccos be allowed to join larger cooperative societies for stronger representation and access to services. However, it cautioned that such a move would introduce added governance and financial responsibilities. The Ministry further suggested expanding the Bill to cover tuk-tuk operators for inclusivity.

Meanwhile, the Private Bikers Association of Kenya (PBAK) urged lawmakers to exempt private motorcycle owners from the Bill, arguing that it would be unfair to subject recreational riders to the same rules as commercial boda bodas.

The Committee is expected to consolidate all stakeholder submissions before presenting its report for debate in Parliament.
