Lawyer Wanyama dares Speaker Wetang’ula to sue in escalating defamation row


City lawyer Peter Wanyama has thrown down the gauntlet to National Assembly Speaker Moses Wetang’ula, daring him to proceed with a defamation suit.

In a strongly worded response, Wanyama dismissed Wetang’ula’s claims as baseless and lacking evidence. He insisted his remarks were truthful, fair comment or honest opinion, protections guaranteed under the Constitution.

“Without clear particulars, the allegations are baseless,” Wanyama stated.

The lawyer also faulted Wetang’ula’s legal team for failing to outline which words were defamatory, where they were published, and how they allegedly damaged the Speaker’s reputation.

Wanyama warned against attempts to silence the media or intimidate critics, saying such moves would be fought in court.

On September 3, 2025, Wetang’ula’s lawyers issued a demand letter accusing unnamed publishers of spreading false claims said to injure the Speaker’s reputation. They demanded the stories be pulled down, a public apology issued, and compensation paid, warning of legal action if ignored.

In his reply, Wanyama cited Articles 33 and 34 of the Constitution, which protect freedom of expression and press freedom. He argued that public officials must accept scrutiny and criticism as part of democratic life.

Still, Wanyama left the door open for dialogue, offering Wetang’ula a “right of reply” that could be published alongside the contested story, though he refused to admit wrongdoing.

It remains unclear whether Wetang’ula’s legal team will proceed with a defamation suit or take up the offer for a right of reply.
