Rarieda MP Otiende Amollo plans to introduce a motion to ban former Deputy President Rigathi Gachagua from holding public office. Amollo, a respected lawyer and legislator, argues that Gachagua’s rhetoric threatens national unity. He insists stronger action is necessary after the Senate impeached Gachagua in 2024.

Speaking at a fundraising event in Rongo, Amollo accused Gachagua of fueling ethnic divisions. He reminded him of his past impeachment, saying, “We removed you under Article 75 of the Constitution. That should have been enough, but maybe we didn’t go far enough.” His words signaled Parliament could take even tougher measures.

The Senate impeached Gachagua over allegations of abuse of power and misconduct. Despite his removal, he formed the Democracy for Citizens Party (DCP) and began campaigning against President William Ruto’s influence ahead of the 2027 elections. His critics, especially those in Kenya Kwanza, argue he is using tribal divisions for political gain.

Amollo stressed that Parliament could invoke Article 75(3) of the Constitution, enforcing a permanent ban from public office. He warned, “If you continue with that kind of talk, we will return with a special motion under Article 75(3). There will be consequences.”

Legal experts debated the motion’s viability. Constitutional lawyer Alice Mutua acknowledged its possibility but noted it would require strong political backing. “It’s a difficult process, but it can happen if enough leaders support it,” she said.

Gachagua, meanwhile, defended his stance, claiming he is promoting a “people-driven agenda” and exercising his democratic rights. However, analysts argue his words threaten unity. Political analyst Joseph Mwangi observed, “Gachagua has the right to form a party, but if his rhetoric harms national unity, it becomes a constitutional issue, not just politics.”
