Kiambu Senator Karungo wa Thang’wa has accused President William Ruto of committing a “gross violation of the Constitution” by assenting to seven Bills that, according to him, were never tabled before the Senate as required by law.
In a strongly worded statement issued on Wednesday, Senator Karungo said the move undermines the principle of bicameralism and weakens the foundation of devolution. He claimed that President Ruto’s decision to sign the Bills on October 15, 2025, was unconstitutional and politically questionable, given it coincided with the national mourning period for the late former Prime Minister Raila Odinga.
“On Wednesday, 15th October 2025, President William Ruto committed a gross violation of the Constitution by assenting into law seven Bills, seven of which were never brought before the Senate as required under Article 110 of the Constitution,” the statement read in part.
“The Senate, which represents and safeguards the interests of the counties, was unlawfully bypassed. This act not only undermines the principle of bicameralism but also strikes at the core of devolution, a cornerstone of our constitutional order.”
According to the senator, the seven Bills that allegedly never reached the Senate are:
1. The Computer Misuse and Cybercrimes (Amendment) Bill, 2024
2. The Privatisation Bill, 2025
3. The Wildlife Conservation and Management (Amendment) Bill, 2023
4. The National Police Service Commission (Amendment) Bill, 2024
5. The Air Passenger Service Charge (Amendment) Bill, 2025
6. The Virtual Asset Service Providers Bill, 2025
7. The National Land Commission (Amendment) Bill, 2023
Karungo termed the timing of the presidential assent “a deliberate and cynical move,” accusing the President of sneaking in the approvals while the nation was mourning.
“In what can only be described as a deliberate and cynical move, the President chose to sneak the assents, ‘like a thief in the night,’ yet in broad daylight, and on a day when the entire nation was mourning the passing of the late Rt. Hon. Raila Amolo Odinga, a statesman who spent his life defending democracy and constitutionalism,” he said.
The Kiambu senator questioned the motive and urgency behind the President’s decision and urged the Senate leadership to seek judicial intervention.
“We must ask: Why did the President proceed to sign these Bills into law despite clear constitutional guidance and legal precedent requiring the Senate’s input? What urgency or motive justified such a blatant disregard of due process?” he posed.
In his statement, Karungo called on the Senate leadership to seek an advisory opinion from the courts under Articles 110, 111, 112, and 163 of the Constitution. He also appealed to the Council of Governors, civil society, and the youth to defend constitutional integrity.
“This is not a partisan issue, it is a national concern. The Constitution of Kenya belongs to the people, not to Ruto, not to the Executive. We will not allow any arm of government to mutilate, ignore, or sidestep it for political convenience or expediency,” Karungo concluded.
The Senator’s remarks are likely to spark a fresh constitutional debate over the legislative process and the limits of presidential power.
