Senator Ledama warns Ruto against forcing counties into e-procurement, cites constitutional breach

Narok Senator Ledama Ole Kina has cautioned President William Ruto against compelling counties to adopt the electronic government procurement (e-procurement) system, warning that such a directive risks breaching constitutional limits and sparking costly legal battles.

In a statement issued on Monday, September 1, via his official X account, Ledama said that while the president’s intentions may be good, enforcing the system on counties goes beyond the mandate of the national government.

He argued that compelling counties to comply would force devolved units to engage in expensive court cases, draining public resources and stalling development projects.

“With the utmost respect, Mr. President, county governments are constitutionally semi-autonomous. Article 219 clearly mandates that counties receive their equitable share of revenue without undue delay and without deduction,” Ledama stated.

“While the intent behind the e-procurement directive is understood, imposing it on counties exceeds the powers granted to the national government by the Constitution,” he added.

The senator threw his support behind the Council of Governors, saying it was right to resist the directive in order to safeguard devolution. He emphasized that respect and consultation between the two levels of government are essential for progress and unity.

“The Council of Governors is right to firmly defend county autonomy and call for mutual respect and proper consultation in line with the law,” Ledama noted.

“Respectfully, all levels of government must honor their constitutional limits to preserve Kenya’s unity and progress,” he added.

President Ruto, however, has dismissed resistance to the reforms, insisting that the shift to the digital procurement system is central to his fight against corruption and wastage in government.

Speaking during a visit to Siaya on Sunday, August 31, Ruto said leaders opposing the reforms should step aside if they cannot align with his administration’s agenda.

“On e-procurement, there are a lot of people who are used to mischievous conduct when it comes to procurement. We have said that we will have e-procurement so that we can know how much something was bought for and is being sold at,” Ruto said.

“I know there is resistance from e-procurement and accounting officers who do not want that. That is why they are sponsoring headlines of how Mbadi spent billions in a non-working system,” he added.

The standoff now underscores growing tensions between the push for digital reforms by the national government and the counties’ demand for autonomy as protected by the Constitution.
