Court fines PCEA Secretary-General and moderator for contempt over defiance of orders barring treasurer’s installation

The High Court has fined senior leaders of the Presbyterian Church of East Africa (PCEA) for contempt of court after finding that they willfully disobeyed a standing court order.

PCEA Secretary-General Rev. Dr. Patrick Waihenya was fined Ksh150,000, while the church’s moderator, Rev. Dr. Thegu Mutahi, was fined Ksh100,000 for defying orders that barred the installation of David Nderitu Ndumo as the PCEA Honorary Treasurer.

In her ruling, Lady Justice Stella Mutuku said the two clerics were fully aware of an injunction issued on April 8, 2024, but went ahead to participate in the installation, in clear breach of the court directive.

The judge noted that the conduct amounted to deliberate disobedience of lawful court orders, emphasising that no individual or institution is above the law.

Justice Mutuku directed the clerics to pay the fines, warning that failure to comply would attract further legal consequences. She underscored that respect for court orders is fundamental to the rule of law and must be upheld by all, regardless of office or status.
