Court orders Ferdinand Waititu to forfeit Ksh131 million

Former Kiambu Governor Ferdinand Waititu has secured partial relief after a court ordered him to forfeit Ksh131 million worth of assets to the State, significantly lower than the Ksh1.9 billion initially sought by prosecutors.

In a ruling delivered on Friday, Justice Nixon Sifuna partly allowed a civil recovery case filed by the Ethics and Anti-Corruption Commission (EACC), which had accused Waititu and his wife, Susan Ndung’u, of holding unexplained wealth.

The court ordered the forfeiture of selected assets, including two plots of land valued at Ksh32 million, a Caterpillar construction tractor worth about Ksh11 million, and two vehicles valued at approximately Ksh600,000 each.

Justice Sifuna ruled that the couple failed to adequately demonstrate lawful acquisition of the forfeited assets. However, he declined to grant full recovery, finding that EACC had not presented its claims with sufficient clarity or supported them with strong evidence to justify seizing all the properties listed.

The case dates back to 2022, when EACC alleged that Waititu amassed over Ksh1 billion in unexplained wealth while serving as Kabete MP and later as Kiambu governor.

The ruling comes months after Waititu was sentenced to 12 years in prison or fined Ksh52.5 million in a separate corruption case.
