The National Environment Management Authority (NEMA) has issued a tough warning to Kenyans as it begins a nationwide crackdown on the re-emergence of banned plastic bags.
In a notice released on Tuesday, September 23, the Authority said any person found importing, manufacturing, selling, or using plastic bags faces a fine between Ksh2 million and Ksh4 million, or a jail term of one to four years, or both.
NEMA noted with concern that illegal plastic bags are resurfacing in shops and households despite the 2017 ban. The Authority pledged to intensify inspections and enforcement across the country to ensure compliance with the law.
“Any person who manufactures, imports, exports, uses, sells, offers for sale or possesses plastic carrier bags or flat bags without a license commits an offence and shall, on conviction, face these penalties,” the notice read.
The Authority reminded Kenyans that exemptions only apply to primary industrial packaging and garbage liners, which must be licensed and labelled with manufacturer and user details for traceability.
