The Ethics and Anti-Corruption Commission (EACC) has launched a court battle to recover nine acres of public land in Ruiru, Kiambu County, valued at Ksh.250 million.
The land, which was set aside for the construction of a public secondary school within the Kahawa Sukari Residential Scheme, was allegedly grabbed and converted into private residential plots.
According to court documents filed before the Environment and Land Court in Thika, EACC accuses Kahawa Sukari Limited of unlawfully selling the land to James Mwangi Wagura and Lucy Waruguru Wagura in 2005 before the school was developed.
The commission says the transaction was fraudulent since the property, surrendered by Kahawa Sukari Limited for public use, was never supposed to be sold or changed to private ownership.
EACC also faulted the former Kiambu County Director of Physical Planning for irregularly approving a change of land use from educational to residential, which later allowed subdivision of the land into 37 plots.
“The purported change of user, subdivision, and issuance of titles were illegal, null and void,” reads part of an affidavit filed by EACC.
The anti-graft agency is seeking to have all the titles revoked and the land reverted to the government to serve its original purpose the construction of a public school.
A temporary injunction has already been issued restraining the defendants Kahawa Sukari Ltd, James Mwangi Wagura, and Lucy Waruguru Wagura from selling, transferring, or developing the land until the next court hearing scheduled for November 20, 2025.
