Former Kiambu Governor Ferdinand Waititu, popularly known as Baba Yao, is facing fresh legal trouble even as he serves a 12-year jail term at Kamiti Maximum Prison.
On Tuesday, November 11, prosecutors filed new charges against the ex-governor over remarks he allegedly made at Ruiru Stadium, Kiambu County, on September 29, 2024 comments said to have been deliberately provocative and capable of disturbing public peace.
According to the prosecution, Waititu’s statements, which referenced impeachment proceedings against former Deputy President Rigathi Gachagua, could have incited unrest among groups including market traders, boda boda riders, and clergy.
“If Gachagua goes home, then President Ruto must also go,” Waititu allegedly told the crowd, a statement prosecutors argue contravenes Section 94(1) of the Penal Code, which prohibits utterances likely to cause public disorder.
The Office of the Director of Public Prosecutions (ODPP) confirmed that the case will proceed to hearing next week, signaling renewed legal battles for the embattled politician.
Waititu, who was convicted in February 2025 for conflict of interest and dealing with suspect property, has been serving his sentence at Kamiti Prison. He was also barred from holding public office for 10 years.
His legal team has made several unsuccessful appeals to secure his release, with the most recent bid in September 2025 rejected by the High Court after failing to raise the required Ksh53 million bond.
Justice Lucy Njuguna ruled that further bail applications would only serve to delay justice.
The fresh charges mark yet another setback for the former county boss, whose fall from power has been marred by a string of corruption, incitement, and integrity-related cases.
